Real life Jagamae Thanndhiram !!!
There is a Tamil movie named Jagame
Thandhiram that was released in 2021, in which some painful incidents about Refugees,
Importance of Visa paper and illegal immigration has been pictured realistic.
Those incidents are not just in movie, even today people are being arrested and
sentenced to jail as illegal immigrants, many fishermen are arrested as they
cross boundaries. People of our country are also victims in such cases.
Following are such incidents,
Almost 6 years ago 17 Indians
including 4 women were arrested in Pakistan, and they were sentenced to
jail. The sad part is they were mentally ill and do not know their
details.
So even though their sentence period expired, they had to
be in jail until the government finds their details. That country government
informed all their boundary sharing countries including India with an intension
to get their details. But unfortunately, till today none of their details were
found. So as a next step, their photos are shared in Pakistan government
website requesting help from common people. Painfully even after 6 years of
their sentence expiry, they are still in jail. This is not the only case. There
are many more similar incidents.
On the month of May in 2019 a person
named Ramesh Daba belonging to Nana Wada in Gujarat was arrested by Pakistan
Navy as he crossed the boundary limit. Even though his jail period got
expired on July 3rd, He was neither released nor given a chance to
contact Indian embassy. After being subjected to many brutalities in
Pakistan jail, On March 36th, 2021, he passed away in Pakistan Karachi milli
jail hospital. His body was also never given back to his family.
As a solution for such problems, In
the year of 2008 India Pakistan government had signed a memorandum of
understanding,
In that they have clearly mentioned below two conditions,
>If suppose a citizen of one country gets arrested in another country and gets sentenced to jail, then that person should be given an opportunity to contact Embassy. So that this will also be useful to confirm their nationality
>A person sentenced to jail should be sent back to his native land within one month of expiry of his sentence period
But Ramesh daba was neither sent back to his own land nor
given an opportunity to contact Embassy. What else can we call this other than Human
rights violation.
This is not only about one person;
more than 300 fishermen are in Pakistan milish jail. Whether a non-convicted
prisoner or convicted prisoner, he will be able to prove his nationality only
if he is given an opportunity to contact the embassy. Without contacting embassy,
it is not possible for a person to get back to his native place.
In 2018 Latheef kasim belonging to Hach
district in Gujarat was arrested by Pakistan government as he crossed
boundary limits. He was also neither released after expiry of his sentence
period nor given an opportunity to contact embassy. One of his relative
Ismail Shaba was also arrested for same reason and he was released in the month
of January 2021. But the sad part is his sentence period has expired in 2016.
Almost 5 years he has been punished after the sentence period expiry.
Generally, the prisoner should be sent
back to their native place on the day of their sentence expiry. But this has
been never possible with Pakistan.
In order to find a solution for this
problem, in 2007 both the countries formed a joint justice committee. In this
committee retired judges belonging to both countries, 4 from India and 4
from Pakistan were present. It is a practice that this committee should
meet the prisoners twice a year. They will also recommend the fishermen and
women to be sent back to their native. This was in practice until 2013 and
unfortunately it was dropped after that.
India took steps to bring back the committee to be active. But as no one from Pakistan was nominated as the member this was put on hold. Due to this we had been pushed to a situation losing many lives for this.
Let us all pray for this situation to
change soon, and we get justice!
